Terms of Service

These Terms of Service govern your access to and use of MyWPBackups websites, applications, WordPress plugins, backup services, recovery tools, storage, support, and related services. By creating an account, connecting a site, installing our plugin, purchasing a plan, or using the services, you agree to these Terms.
1. Services
MyWPBackups provides WordPress backup and recovery software, including account management, site connection, scheduled backups, off-site storage, recovery point listings, restore requests, downloadable backup archives, alerts, and related tools. Services may change over time, and some features may be limited by plan, storage allowance, retention period, site configuration, hosting environment, third-party providers, or technical constraints.
2. No Insurance, Warranty, or Guarantee
MyWPBackups is not an insurance product and does not provide legal, financial, cybersecurity, compliance, or risk-transfer insurance services. We do not guarantee that every backup, restore, download, storage object, alert, schedule, or recovery attempt will be successful, uninterrupted, timely, complete, error-free, or compatible with every WordPress installation or hosting provider.
You are responsible for maintaining your own independent backup, security, business continuity, incident response, and disaster recovery procedures. You should test restores and verify that the service meets your needs before relying on it for critical operations.
3. Accounts and Security
You must provide accurate account, billing, and site information. You are responsible for maintaining the confidentiality of your login credentials, administrative users, plugin tokens, API keys, connected WordPress accounts, and any device or system used to access the service. You are responsible for all activity under your account unless caused solely by our proven unauthorized access to our own systems.
4. Site Data and Authorization
By connecting a WordPress site, you represent that you own or are authorized to administer that site and to transmit its data to MyWPBackups for backup, storage, processing, restore, download, support, troubleshooting, and service operation. WordPress backups may include database contents, uploads, themes, plugins, configuration files, media, private files, user records, comments, order data, API keys, credentials, logs, and other sensitive information depending on your site.
5. Acceptable Use
You may not use MyWPBackups to store, back up, transmit, restore, distribute, or facilitate content or activity that is unlawful, abusive, harmful, fraudulent, infringing, exploitative, or otherwise prohibited. Prohibited content and activity includes, without limitation:
- Illegal content or activity of any kind.
- Illegal pornographic content, non-consensual intimate material, or other prohibited adult content that creates legal, compliance, or abuse risk for the service.
- Pornographic or sexually explicit content where storage or processing creates legal, compliance, or abuse risk for the service.
- Copyrighted, trademarked, or proprietary content that you do not have the right to store, copy, process, or restore.
- Malware, botnets, credential theft, phishing kits, spam tools, exploit kits, or systems used to attack, compromise, or abuse others.
- Content that promotes violence, terrorism, trafficking, harassment, doxxing, hate, or threats.
- Attempts to bypass usage limits, security controls, authentication, storage limits, deletion rules, or service restrictions.
If we determine, in our sole discretion, that your account, site, content, or use violates these Terms or presents legal, security, operational, reputational, or abuse risk, we may suspend or terminate service immediately, restrict access, disable backups or restores, preserve or delete data, report activity to authorities, and cooperate with legal requests.
6. Backups, Restores, and Customer Responsibility
Restore is a technical process affected by WordPress state, hosting permissions, database access, disk space, PHP limits, network conditions, plugin conflicts, malware, third-party changes, user actions, and other factors outside our control. You are responsible for confirming what will be restored, maintaining access to your WordPress site and hosting account, reviewing restore logs, and keeping separate backups for critical systems.
A plugin-based restore may not be available if your site, WordPress admin, hosting account, database, filesystem, or network is unavailable. Downloadable archives and emergency procedures may require manual technical work by you or your hosting provider.
7. Plans, Billing, Storage, and Retention
Plan prices, storage allowances, retention periods, included features, billing intervals, and overage policies are shown during checkout or in your account. Unless stated otherwise, subscriptions renew automatically until canceled. Failed payment may result in suspended backups, restricted restore/download access, account limitation, or deletion after notice and applicable retention periods.
Storage and retention are not unlimited unless a written agreement expressly says so. We may enforce storage caps, fair-use limits, file exclusions, bandwidth limits, job limits, rate limits, and abuse controls.
Backups may skip unusually large files, generated files, caches, backup archives, exports, or other files that are not appropriate for normal WordPress backup storage. We may also warn, limit, pause, or fail backup jobs for sites with excessive file counts or other resource patterns that could harm service reliability or exceed reasonable plan usage.
8. Third-Party Services
The service may rely on third-party providers, including hosting, payment processors, email providers, analytics, infrastructure, storage, content delivery networks, WordPress, WordPress plugins, and your web host. We are not responsible for third-party services, outages, security incidents, terms, pricing, behavior, or data practices.
9. Support
Support may be provided by email or other channels we make available. Support does not include guaranteed managed restore, malware cleanup, development work, hosting administration, legal compliance, or emergency response unless expressly included in your plan or written agreement.
10. Intellectual Property
MyWPBackups, the service, software, designs, trademarks, documentation, and related materials are owned by us or our licensors. You retain ownership of your website content and data. You grant us the rights necessary to provide, secure, troubleshoot, store, transmit, restore, improve, and support the service.
11. Disclaimers
The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, data integrity, and uninterrupted operation.
12. Limitation of Liability
To the maximum extent permitted by law, MyWPBackups and its owners, employees, contractors, affiliates, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, lost profits, lost revenue, lost data, business interruption, reputational harm, security incidents, restore failure, or cost of substitute services. Our total liability for any claim will not exceed the amount you paid to MyWPBackups for the affected service during the three months before the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless MyWPBackups and its owners, employees, contractors, affiliates, suppliers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your sites, data, content, use of the service, violation of these Terms, violation of law, infringement of rights, or misuse of credentials or connected systems.
14. Suspension and Termination
You may cancel your subscription according to the cancellation process we provide. We may suspend or terminate access for nonpayment, abuse, security risk, legal risk, prohibited content, excessive resource use, or violation of these Terms. After cancellation or termination, backups may be retained or deleted according to the applicable plan, grace period, legal requirements, and operational policies.
15. Changes
We may update these Terms from time to time. Changes are effective when posted unless a later effective date is stated. Continued use of the service after changes become effective means you accept the updated Terms.
